Conveyancing Queensland
Trusted Caboolture Conveyancers
Conveyancing is the legal process of transferring real estate ownership between different parties. It is often seen as a ‘routine’ process and many people would have been a party to a conveyancing transaction at least once in their lifetime. Property transactions, however, can be risky. Conveyancing involves preparing and reviewing legal documents, conducting property searches, and ensuring all requirements are met for a smooth and valid transfer. A property transaction typically moves quickly – strict deadlines must be met and the potential penalties for not meeting your contractual obligations can be significant.
Proctor Graham Lawyers focuses heavily on conveyancing and property law. We specialise in all property transactions including residential and commercial sales and purchases. We cater to a range of clients and our services are high-quality and reasonably priced.
Conveyancing for Buyers
Entering a contract to buy property creates legal obligations, so you need to know what you are getting and understand your legal position before contracts are binding.
Due diligence can help you make informed decisions. For example, you’ll want to know that the property you propose to buy can be used for its intended purpose, that you understand the implications of any easements or other restrictions on the land, and that the structures are compliant. There are a range of investigations you can arrange for these purposes. Building and pest inspections, which should also form part of your investigations, can flag potential issues and save you from costly surprises before it’s too late.
A standard contract cannot deal with the individual circumstances of every transaction, so it is important to have it reviewed before you enter a legally binding arrangement. Our property team has settled numerous conveyancing transactions and can flag potential issues. We will explain your rights and responsibilities under the contract and help you negotiate any special conditions if necessary.
Once contracts are binding, we will carry out additional property searches (title search, council searches, etc.) to check for any encumbrances or issues, liaise with your lender, and prepare for settlement.
Conveyancing for Sellers
If you decide to sell your property, you will need a contract drafted containing certain disclosures. As each property is unique, you should obtain advice specific to your property and circumstances.
In Queensland, the real estate agent typically prepares the draft contract, however, before listing with an agent, we recommend discussing your proposed sale with us so we can consider matters such as:
-
- the prescribed warning and disclosure statements required
- the inclusion of fixtures and fittings
- any obligations under existing rental agreements
- any alterations you have made to the property
- whether there is a mortgage over the property
- additional conditions to protect your interests
- the settlement date and whether you plan to buy another property
Once a buyer is found we will liaise with your agent, the buyer’s legal representative, and your outgoing mortgagee (if relevant) and deal with any enquiries to ensure your sale is settled as seamlessly as possible.
Electronic Conveyancing
Traditionally, settling a property transaction involved the physical meeting of lawyers and financial institutions to exchange paperwork and bank cheques. Documents would then need to be lodged with government bodies to transfer the title and change ownership.
E-conveyancing has changed this process through an electronic platform that removes the location and time barriers of physical settlements. E-conveyancing enables lawyers, conveyancers, and financial institutions to transact online, improving transparency and efficiency, and streamlining manual processes and paperwork. The online system tracks the various stages of each transaction and facilitates the online lodgement of documents and faster access to sales funds.
Buying or selling a home is likely one of the largest financial decisions you will ever make, so it is important to put your property matter in the hands of a trusted professional. Proctor Graham Lawyers is experienced in all aspects of conveyancing in Queensland and will guide you through the entire process, protecting your interests and explaining your rights and responsibilities so you can make informed decisions about your investment.
